Terms of Service

These terms apply to the ClutchUp app and clutchup.games, operated by Cache Studios LLC (“we”, “us”). By using ClutchUp you agree to them. They describe the current free-to-play beta; if we add new features, such as paid contests, we’ll publish updated terms first.

The beta

ClutchUp is in beta. Features may change, break or be removed, and we may reset game data, including coin balances and results, while we test. Please report problems to support@cachestudios.io.

Beta coins have no value

In the beta, coins are free play credits with no monetary value. They’re given to you at sign-up, can’t be bought, can’t be exchanged for money or anything else of value, and can’t be transferred or cashed out. There are no purchases in the beta. We may adjust or reset coin balances at any time.

Beta coins are for testing only. They won’t carry over into, or be converted into money, credit or anything else in, any future version of ClutchUp.

Eligibility and your account

You must be at least 17 years old to use ClutchUp. You’re responsible for your account and for keeping your sign-in secure. One account per person. You can delete your account at any time in the app (Account → Delete account), as described in our Privacy Policy.

Fair play

ClutchUp games are decided by skill: in a Duel, both players play the same board and the higher score wins. Our servers replay each round to confirm its score, and our result is final. You agree not to:

• cheat, use bots, scripts or modified apps, or exploit bugs;
• play on someone else’s account, run multiple accounts, or arrange results with other players;
• harass other players or choose an offensive username;
• interfere with, overload or reverse-engineer the service.

We may void results, reset coins, or suspend or close accounts that break these rules.

Our content

The app, games, designs and content are owned by Cache Studios LLC. We give you a personal, non-transferable right to use ClutchUp for your own entertainment while you follow these terms.

No warranties

ClutchUp is provided “as is” and “as available”, without warranties of any kind, to the extent the law allows. We don’t promise it will be uninterrupted, error-free, or that data will never be lost.

Limitation of liability

To the extent the law allows, Cache Studios LLC is not liable for any indirect, incidental or consequential damages arising from your use of ClutchUp. Because the beta is free, our total liability to you for any claim is limited to $50.

Ending your use

You can stop using ClutchUp and delete your account at any time. We may suspend or end your access if you break these terms or if we discontinue the beta.

Apple

These terms are between you and Cache Studios LLC, not Apple. Apple is not responsible for ClutchUp or its content, and has no obligation to provide support for it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Changes

We may update these terms. We’ll change the date above and, for significant changes, let you know in the app. Continuing to use ClutchUp after an update means you accept it.
